If a trade mark has been removed from the register due to non payment of the prescribed fee, the registrar of trademarks shall, after six months and within one year of expiry of registration is empowered to restore the trademark.
A trade mark refers to any device, brand, heading, label, ticket, name, signature, word, letter, numeral, shape of goods, packaging and combination of colours which distinguishes the goods and services of one business from those of others.
In India registration of trade mark is done as per the Trade Marks Act, 1999 with the Office of the Controller General of Patents, Designs & Trade Marks. The amendments in the Trade Mark Rules, 2017 have addressed all the measures to facilitate online filing of trademarks and thus, the whole process has now become user friendly.
